General Terms & Conditions

General Terms & Conditions:

By participating in any form of business, including the purchase and use of our products or services, you acknowledge that you have read, comprehended, and agreed to these general terms.

1. Acceptance of Terms:

By participating in any form of business, including the purchase and use of our products or services, you acknowledge that you have read, comprehended, and agreed to these general terms.

2. Product Information:

We strive to provide accurate and comprehensive information about our spa products, hot tubs, and services, including specifications, features, and pricing.

2.1. Price Modifications:

Prices are subject to change without prior notice. For current and updated pricing, please visit https://www.aquapool.es/.

2.2. Visual Representations:

Product images, illustrations, or descriptions are for illustrative purposes and may not precisely represent the actual product.

3. Orders & Payments:

3.1. Order Confirmation:

Placing an order indicates your intention to acquire a product or service. Note that all orders are subject to approval by Aquapool Spas S.L.

3.2. Payment Terms:

Details of payment terms, including deposits, are outlined as follows:

3.2.1. Payment Schedule for HOT TUBS, SPAS, or SWIM SPAS:

– Initial Deposit: To confirm the order, the Buyer must submit an initial payment equivalent to 50% of the total purchase cost. This deposit acts as a reservation and initiates order processing.

– Final Payment: The remaining 50% of the total purchase amount is due no later than 7 days before the scheduled delivery date. Failure to adhere to this payment timeline may result in additional storage fees and possible delays in the delivery process. Please refer to the General Fees & Charges page for details.

3.2.2. Payment Schedule for PRODUCTS, SPARE PARTS, and/or SERVICES:

– Full Upfront Payment: To access goods or services provided by Aquapool Spas S.L., the Buyer must make a full upfront payment, covering 100% of the total purchase amount.

– Release of Goods and Services: Goods or services will only be provided upon confirmation of the receipt of the full upfront payment by the Seller.

3.3. Payment Methods:

3.3.1. Convenience in Payment:

Payment for transactions can be conveniently made through bank transfer, credit card, or any other mutually agreed-upon method.

3.3.2. Payment Details:

4. Delivery and Installation:

4.1. Delivery Timing:

An estimated delivery date will be furnished upon order confirmation. However, please note that unforeseen factors such as weather conditions, logistical issues, or customs delays might affect the delivery schedule.

4.1.2. Delivery Coordination:

Our delivery team will communicate to confirm the delivery date and time. Availability on the agreed-upon date is crucial for receiving the delivery.

4.2. Delivery Process:

4.2.1. Address Requirement:

Deliveries will be dispatched to the address provided during the ordering process. It is your responsibility to ensure the accuracy and accessibility of the delivery address.

4.2.2. Access Clearing:

Our delivery team needs unobstructed access to the installation site. Any impediments, such as narrow pathways or obstacles, should be cleared before the scheduled delivery.

4.2.3. Gated Communities or Apartments:

For those in gated communities or apartment complexes, ensure access codes or permissions are provided to our delivery team in advance.

4.2.4. Non-compliance Charges:

Failure to meet the above conditions (4.2.1, 4.2.2 and/or 4.2.3) may result in crane truck fees and a minimum charge of €160. Please refer to the General Fees & Charges page for details.

4.3. Inspection Upon Delivery:

4.3.1. Packaging Examination:

Upon receiving the hot tub, carefully inspect the packaging for any visible damage. If any packaging damage is noticed, record it on the delivery receipt before signing.

4.3.2. Product Inspection:

After unpacking, examine the hot tub for visible damage, scratches, or defects. Any issues should be documented and reported to our delivery team immediately.

4.4. Installation and Setup:

4.4.1. Installation Responsibility:

Unless specified otherwise in the purchase agreement, Aquapool Spas’ service team is responsible for installing and setting up the hot tub.

4.4.2. Installation Instructions:

Detailed installation instructions are provided with the hot tub. Follow them meticulously to ensure proper maintenance and functionality.

4.5. Cancellation and Rescheduling:

4.5.1. Delivery Changes:

To reschedule or cancel a delivery, inform us at least 96 hours in advance to avoid rescheduling charges.

4.5.2. Short Notice Cancellation:

Canceling a scheduled delivery with less than 96 hours’ notice incurs crane truck fees and a minimum charge of €160. These charges reflect time and resource commitments.

4.5.3. Unforeseen Rescheduling:

Unforeseen circumstances, such as adverse weather or technical issues, might lead to delivery rescheduling. Advance notice will be given for alternative arrangements.

4.6. Warranty and Returns:

4.6.1. Manufacturer’s Warranty:

Products are covered by the manufacturer’s warranty, with terms provided alongside each product.

4.6.2.Platform or hot tub base:

Any form of structural damage arising from incorrect installation or placement on an inappropriate base is explicitly excluded from the coverage provided by the spa warranty.

4.6.3. Return Policy:

Return or exchange requests must be initiated within 14 days of goods delivery. After the expiration of the 14-day period, we are unable to accept returns under any circumstances.

5. Maintenance Services:

5.1. Maintenance Scope:

Maintenance services may include water testing, chemical balancing, cleaning filters, checking components, and addressing any minor issues that may arise to enhance your hot tub’s performance and longevity. 

5.2. Service Frequency:

Frequency of maintenance visits is determined based on usage, location, and hot tub model.

5.3. Service Charges:

Maintenance service charges will be communicated before the service visit. Additional repairs or part replacements incur extra charges, discussed beforehand.

5.4. Access and Communication:

5.4.1. Access clearing:

It is your responsibility to provide our maintenance team with clear access to the hot tub. Report any issues between scheduled visits promptly.

5.4.2. Gated Communities or Apartments:

For those in gated communities or apartment complexes, ensure access codes or permissions are provided to our service team in advance.

5.4.2. Reporting Issues:

If you notice any unusual changes in your hot tub’s performance, water quality, or functionality between scheduled maintenance visits, please inform us as soon as possible.

5.5. Payment:

Payment for maintenance services is due before the service visit, or payment upon completion of each visit is required. If payment is not settled by the conclusion of the visit and we need to request payment from the office, an additional administrative fee of 20€ will apply.

5.6. Cancellation and Rescheduling:

5.6.1. Maintenance Changes:

To reschedule or cancel a service visit, inform us at least 48 hours in advance to avoid rescheduling charges.

5.6.2. Short Notice Cancellation:

Canceling a maintenance visit within 48 hours leads to a minimum charge of €80, considering allocated time and resources.

5.6.3. Unforeseen Rescheduling:

Unforeseen circumstances, such as adverse weather or technical issues, might lead to maintenance visit rescheduling. Advance notice will be given for alternative arrangements.

5.7. Warranty on Maintenance Services:

We provide a warranty on the quality of our maintenance services. If you encounter any issues shortly after a maintenance visit, please notify us, and we will rectify the matter promptly. It is important to note that we cannot assume responsibility for the water’s condition in the days that follow.

5.8. Customer Responsibilities:

Ensure the hot tub area is accessible and adhere to maintenance and usage recommendations for optimal benefits.

6. Privacy and Data Security:

Any personal information collected from customers will be treated in accordance with our privacy policy.

7. Confidentiality:

All customer information, transactions, and interactions will be kept confidential.

8. Changes to General Conditions:

We reserve the right to update or modify these general conditions. Any changes will be communicated to customers in advance.

9. Additional Customer Responsibilities:

Customers are responsible for providing accurate information, following care instructions, and maintaining the hot tub as recommended.

10. Liability and Limitations:

Aquapool Spas S.L. is not liable for any indirect, incidental, or consequential damages arising from product usage, placement or services.

11. Dispute Resolution:

Any disputes or disagreements will be resolved through negotiation or mediation, as outlined in separate dispute resolution policies.
